Following an order issued by the Tribunal, the Competition Commission will not be permitted to submit a revised trial bundle in the market division case involving Much Asphalt (Pty) Ltd (Much Asphalt) and Roadmac Surfacing (Pty) Ltd (Roadmac).
This, after the Commission filed an application (for condonation) for the late filing of a revised trial bundle, which included an additional 1221 pages. The application was opposed by Much Asphalt and Roadmac.
The companies, in turn, brought an application for costs in the event that the condonation application was dismissed as well as for wasted costs for the postponement of the hearing. However, the Tribunal does not have the authority to issue a cost order against the Commission and has, therefore, also dismissed the application for costs.
